Factors affecting the authoritarianism of the police with a critical approach to the law on reducing the punishment of imprisonment

Protecting the life and property of citizens, providing security and preventing crimes are the duties of the police. Despite the benefits of the Penal Imprisonment Law of 2019, its shortcomings, which are the basis for the increase of crimes, the deprivation of public comfort, and the escape of criminals, should not be easily passed over; It is inevitable to strengthen the authority of the police in such a way that it can deal with criminal phenomena with measured measures and provide a more comfortable life for citizens; This is achieved by preventing the criminals from abusing the approval of this law and removing the shortcomings of the reports of the officers.

The current research from the point of view of practical purpose and in terms of method; It is an exploratory qualitative study that was conducted with content analysis and the statistical community including judges, lawyers, professors and law enforcement experts investigated the cases of misuse of this law as well as the shortcomings of the reports of the officers. According to the theoretical saturation, the sample size reached 11 people and the data was collected through semi-structured interviews and analyzed through coding.

The cases of abuse by criminals in the legislative mistakes and the most important shortcomings of the reports are summarized in the lack of variety of questions, the lack of accurate mention of events, the lack of using modern scientific methods, and the existence of violations.

Reforming the law and criminal policy, making the police aware of their duties, reforming the investigation and interrogation process, realizing the scientific police, continuing training and dealing with violations and corruption are the solutions obtained to prevent evasion of the law, correcting the shortcomings of reports and increasing the authority of the police.
