Legal requirements for the efficiency of the monitoring and inspection system by emphasizing the relationships of public supervisory authorities

Embedding a control system is one of the common elements of most legal systems, which has been established in different ways in different countries. In the Iranian legal system, Supreme Audit Court (as a specific control body) and State Inspection Organization (as a public control body) are two supervisory bodies with a constitution-based position, both of which form the main foundations of the system of monitoring governmental organizations. The basis of the present study is the necessity of systematic relationships and coordination between supervisory authorities as a definite and rational necessity in establishing a supervision and inspection system in the country. This matter has not been given attention in the laws and regulations of the above two supervisory bodies. This work attempts to answer these questions: Are the supervisory bodies and authorities in a systematic relationship in the Iranian legal system? Is there a specific legal system in this regard, or is the coordination between them left to the practical initiatives of the above bodies? This study was conducted using a descriptive-analytical method. In addition to pointing out the necessity of systematic coordination and communications between control and inspection bodies, this work first investigates the limitations of the competencies of state inspection organizations and the supreme audit court and finally evaluates the coordination mechanisms and the systematic communication between the supervisory bodies. According to the findings, despite the approval of regulations regarding the establishment of coordination between supervisory authorities (especially with the establishment of the Council of Supervisory Bodies), the above mechanism is not clear due to the lack of clear boundaries of the duties of the said authorities and their relationships. The desired results cannot be achieved simply by establishing a special council without providing the requirements.
