Applying theories of socialism and individualism in the adoption and formulation of laws with emphasis on municipal laws
Today, most laws in society are based on the collective interest, while individual and citizenship laws are an important category that in most cases has been ignored. On the other hand, the increase in the population of cities and the subsequent development of public spaces in the city has led to the entanglement and dependence of the rights of many people. This dependence requires restricting individual rights and paying attention to the rights and interests of society, which are mainly expressed and defined in municipal laws. And even in the amendments to the mentioned law, including the amendment to Article 101, it is explicitly stated that public rights are respected over the rights of individuals. But as a result of this research, it should be said that what is observed in the law of municipalities today The approach of the two theories is communitarianism and Individualism in laws. But the law has always sought to best resolve the conflict between public and property rights and to bridge the gap between communitarianism and Individualism. In Iranian law, although the esteemed legislator has made efforts in this regard, but unfortunately the current state of the law is not very satisfactory and does not provide the necessary guarantees to protect the property rights of individuals.
