New Legal Policies for Protection of Cultural Heritage

Abstract:

Cultural Heritage as an inseparable part of human civilization is connected to human identity. So, commitment of States for protection and conservation of cultural heritage should be considered more than what is existing now in Positive law. This article intends to look the protection of Cultural heritage in cadre of human rights and by using the process of evaluation their concepts and related domain find how the protection of cultural heritage could be formed as a stature of human rights by focusing on the role of policies of States. Also, it would reply to this question if the protective mechanisms and frameworks in human rights could be effective and practical for protection of cultural heritage in title of “Right to cultural heritage”? In this regard, in reviewing the concept of cultural heritage and its elements by considering its relation to cultural rights, the different dimensions of relation between cultural rights and cultural heritage be defined and the possibility of formation the “Right to cultural heritage” in State ‘s policies would be measured by human rights tools and concepts.
