Manifestations of restorative justice based on criminal procedure in the investigation and prosecution stag

The course of study in schools and intellectual ideas related to criminology, after going through different stages, took the path towards moderation in punishing the offender and tried to moderate the balance between crime and punishment, in this conceptual way. It was formed under the name of "restorative justice", so the main effort of this article was based on the goal that the manifestations of restorative justice were the focus of the Iranian criminal procedure in the investigation and prosecution stage.

The method of the present study is descriptive and analytical according to the qualitative type and was explained by the library method and by referring to authoritative books and articles in this field and restorative justice and the law of criminal procedure.

The findings show that the three sides of "restorative justice", the offender, the victim and the community; They are closely related, the first calls for fair prosecution, investigation and investigation, the second for waiting, healing, reparation and restoration of the status quo, and the third seeks to maintain public order, good morals and develop justice in the punishment system, hence the approval and legislation And even the revision of laws must recognize and take steps to ensure the effective presence of all parties in the process, actions and procedures based on "restorative justice"; Therefore, the Code of Criminal Procedure has also benefited from the perspective of trying to assess justice in its restorative.
