The Analysis of Legal System Governing Money Laundering In Iran

Money laundering is considered as an organized crime committed by offenders it in order to conceal the source of money gained from illegal activities by disguising these activities as legal in an effort to make a huge profit. To combat this kind of crime international organizations including United Nations and different countries have taken various measures. Till 2007 money laundering was not considered as an independent crime in Iranian legal system, but obligations of international conventions including United Nations Convention on Fight against Narcotics and Psychedelic Drugs- adopted in December, 20, 1998, known as Vienna Convention (article 3) – on the one hand and legal and judicial requirements on the other led to the adoption of money laundering rules. Considering newly established legal system of fight against money laundering in I.R.Iran and also some social and economical necessities, the basic question is to what extent the rules of fight against money laundering will be able to respond to the judicial needs of the society? Do these existing rules fit with the nature of money laundering crime as an organized crime? This article intends to analyze the rules of fight against money laundering. It will seek to investigate the gaps and shortfalls of these rules by taking into account the existing conventions and rules of other countries.
