Analysis of the legal nature of Islamic Azad University

After the victory of the Islamic Revolution in Iran, the lack of human resources, the imposed war, widespread sanctions, and the heterogeneous structure of higher education with a revolutionary atmosphere led the authorities at the time to establish institutions outside the rules and structure of public universities. The goal was to make these institutions independent of the government budget. Therefore, Islamic Azad University was established in 1982 and in a short period of time, this university started operating in 14 units throughout the country. The main question of the article is in this regard, what is the nature and position of the Islamic Azad University in the legal system of the country? Islamic Azad University was the first non-profit higher education institution after the Islamic Revolution and is also associated with the Islamic Revolution. This institute has always had special privileges, both in its establishment and in its expansion. These privileges can be studied in legal, legal and financial fields. As a result, this institution can not be considered as a private institution or even the same level as other non-profit higher education institutions and it seems that due to its revolutionary nature, according to the available legal evidence and acknowledgment of its founders, legal nature such as institutions It will be public and revolutionary.
