Military criminal law as one of the most important trends in the field of criminal law, which compared to the doctrines of civil law, seems controversial and challenging in terms of apparent difference. When we present military criminal law to the doctrines of civil rights, many commonalities and differences between these two areas crystallize, which are important to address from a scientific and research point of view. In order to create a transformation in the current structures of military criminal law and achieve its lofty goals based on the doctrines of citizenship rights, the charter of citizenship rights of the presidential institution is an academically appropriate example so that military criminal law can be evaluated from the point of view of the doctrines of citizenship rights. Gave In this regard, by carefully examining and analyzing the data, the extent of the connection between civil rights and military criminal law in terms of the rights and duties of military personnel in relation to civil rights, especially judicial officers, in terms of playing the role they are responsible for according to the provisions of the Charter, is examined as a common chapter. has taken. The research method in this study is descriptive-analytical, and primary information was collected through the library method. After analyzing the primary data, the results of the theoretical study of civil rights and military punishment have been analyzed. The findings and results indicate that although some current structures of military criminal law have been drawn based on the doctrines of civil rights, but this legal trend has shown resistance to changes in civil rights due to its history in the legislation and punishment-oriented nature of its penal institutions.
