Analyzing the Issue of Eligibility (from Embryonic to Maturity) in the Issue of Endowment from the Perspective of the Qur'an and Imami Jurisprudence

One of the important and fundamental elements in the holy religion of Islam is the issue of endowment in society, the institutionalization and expansion of its culture in society leads to the foundation and growth of spiritual and divine values, and also leads to the reduction of social poverty and the increase of the relative level of prosperity in the society. The society becomes Islamic. Considering the scope of the endowment category and the series of conditions involved in this issue, such as; The conditions of the waqf, the conditions of the endowment property, the legal personality of the waqf, etc., one of the conditions that make the waqf valid is the eligibility of the waqf, since the correctness of the waqf is one of the requirements of this issue. It deals with the perspective of the Quran, Imami jurisprudence and Iranian civil law, and examines the legal and jurisprudential character of the Waqif in terms of eligibility. The method of conducting descriptive research and the method of collecting information and data is library. The findings and results of the research indicate that the legal laws in the country are derived from the jurisprudence rules of the Imami jurists and they do not contradict each other in this matter. From the point of view of Imamiyyah jurisprudence and legal laws, the waqif must have the authority required in transactions and also possess ownership and authority over what he intends to endow, so that the deed of endowment is correctly concluded.
